Ryan J. McBrayer

Ryan J. McBrayer is a patent litigation attorney with extensive experience representing technology companies in disputes spanning district courts, the International Trade Commission (ITC), the Patent Trial and Appeal Board (PTAB), and the U.S. Court of Appeals for the Federal Circuit. His practice focuses on patent and technology-centric trade secret cases, with particular expertise in wireless networks, including handsets, protocols, network infrastructure, and applications. He also handles matters involving interactive entertainment, immersive technology, 5G technology, and communications.

Mr. McBrayer has experience working on both the plaintiff and defendant sides of patent litigation, with one tracked appearance for each. While at Baker Botts, he served as lead counsel for the plaintiff in DISH DBS Corporation et al. v. Comcentric, Inc. He also appeared as Of Counsel for the defendant, DraftKings Inc., in AG18, LLC v. DraftKings Inc. during his tenure at Perkins Coie.

Currently a Partner at Perkins Coie LLP in Seattle, Mr. McBrayer has a track record of notable outcomes. He successfully obtained a jury verdict of invalidity and noninfringement for T-Mobile in a multi-defendant patent litigation involving wireless data cards. He also defended HTC in actions concerning operating systems and mobile handsets before the ITC and the District of Delaware. In a case for McAfee, he secured a victory where the district court stayed litigation pending inter partes reviews (IPRs), the PTAB subsequently declared all challenged claims unpatentable, and the Federal Circuit affirmed these rulings.

Mr. McBrayer is admitted to practice in Washington and before the U.S. Patent and Trademark Office. He earned his J.D., with honors, from the University of Washington School of Law in 1998, and a B.S., with distinction, from the United States Naval Academy in 1992.
