Rudy Y. Kim

Rudy Y. Kim is a highly experienced patent litigator with over 25 years in high-stakes intellectual property and technology-related disputes. Based in Paul Hastings' Palo Alto office, where he serves as Chair of the Litigation Department, Mr. Kim focuses his practice on patent infringement, trade secret misappropriation, and complex commercial claims. His matters frequently involve cutting-edge technologies such as semiconductors (design and fabrication), computer hardware and software, wireless communication, autonomous vehicles, consumer electronics, data storage, network security, and medical devices.

Mr. Kim primarily represents defendants, particularly operating companies, in patent litigation. His single tracked appearance, Redstone Logics LLC v. MediaTek, Inc. et al., shows him as lead counsel defending MediaTek in a case concerning multicore processor technology. This aligns with his broader practice of defending technology enterprises like Autodesk, Netgear, Logitech, TSMC, and Uber against patent infringement claims, often securing favorable outcomes such as dismissals, summary judgments of non-infringement, and successful trial defenses. Prior to joining Paul Hastings in 2023, Mr. Kim spent over 15 years at Morrison & Foerster LLP, where he chaired its Silicon Valley litigation group.

His experience extends to proceedings before the U.S. International Trade Commission (ITC) and the U.S. Patent and Trademark Office (USPTO). Mr. Kim is particularly active in PTAB and IPR proceedings, having successfully initiated inter partes review (IPR) to stay cases and utilized Covered Business Method (CBM) challenges that led to asserted claims being found unpatentable by the PTAB.

Mr. Kim earned his J.D. from Georgetown University Law Center in 1998 and holds a B.S.E.E. from the University of California, Los Angeles, obtained in 1994. He is admitted to the California Bar and to practice before the United States Patent & Trademark Office, and notably served as a law clerk to the Honorable Alan D. Lourie of the United States Court of Appeals for the Federal Circuit.
