Specialty & background

Ruben J. Rodrigues is a first-chair trial and appellate lawyer at Foley & Lardner LLP, where he focuses his practice on complex patent litigation, license disputes, and intellectual property-related antitrust matters. He has extensive experience across a broad spectrum of technologies, including software, semiconductors, medical devices, gene sequencing, spatial transcriptomics, research tools, exercise equipment, telecommunications, 3D printing, artificial intelligence, lighting, health monitoring, and offshore technologies. His client base includes technology companies, universities, and academic research institutions.

While tracked appearances show one plaintiff-side engagement, Rodrigues's broader practice includes representing both patent holders and accused infringers. He has represented technology companies and universities in asserting their patent rights, and has also defended global electronics companies against patent-holding entities, and business intelligence software developers against competitors.

Rodrigues has significant experience in post-grant review (PGR) proceedings before the U.S. Patent & Trademark Office (PTAB) and subsequent appeals to the U.S. Court of Appeals for the Federal Circuit. He has handled numerous cases, often involving over $100 million in dispute, and is noted for his work in venues such as Massachusetts, Delaware, Texas, California, Illinois, and the International Trade Commission (ITC).

A notable case includes representing 10x Genomics, Inc. as a plaintiff against NanoString Technologies, Inc. In this matter, a U.S. District Court jury found NanoString infringed and awarded approximately $31.5 million in damages in November 2023. While a preliminary injunction was initially granted by the Munich Local Division of the Unified Patent Court (UPC) in a related European action, it was subsequently overturned by the UPC's Court of Appeal in February 2024. Rodrigues earned his B.S. in electrical engineering and computer science with a minor in mechanical engineering from MIT, an M.A. from Northeastern University, and his J.D., with honors, from the University of Chicago Law School. He is admitted to practice in Illinois and Massachusetts, before the U.S. Patent & Trademark Office, and in several U.S. District Courts and Courts of Appeals, including the Federal Circuit.
