Specialty & background

Robert J. Benson is a highly experienced patent litigator with nearly 35 years dedicated to intellectual property disputes, particularly in high-stakes patent litigation. He is a partner at Baker Botts L.L.P., having joined the firm in February 2024 from Orrick, where he led their Taiwan practice.

Benson's practice focuses on complex intellectual property litigation, including district court actions, International Trade Commission (ITC) investigations, and Patent Trial and Appeal Board (PTAB) proceedings. His technological expertise spans a wide range of areas, including semiconductors, graphics processing, mobile devices, computer hardware and software, medical devices, Wi-Fi chips, and various consumer electronics components such as LCD panels, IFP displays, LED products, controllers, and memory devices. He has a significant focus on serving clients in Asia, particularly Taiwan, and is recognized as an "IP-Foreign Expert for Taiwan" by Chambers Global.

He has a balanced practice, successfully representing both plaintiffs and defendants. Notable case work includes his role as lead counsel defending Innolux Corporation in Phenix Longhorn, LLC v. Innolux Corporation, a display technology patent case that ended in a voluntary dismissal. In parallel, Innolux Corporation initiated an inter partes review (IPR2025-00044) against Phenix Longhorn related to the '788 patent. Benson's experience also features securing summary judgments of invalidity and non-infringement, obtaining dismissals with prejudice in patent infringement actions by non-practicing entities (NPEs), and achieving favorable settlements in multi-jurisdictional disputes and ITC investigations. His PTAB experience is extensive, including successfully litigating IPR petitions resulting in unpatentability decisions and securing denials of institution for petitions filed by Qualcomm.

Robert J. Benson earned his J.D. from the University of California, Berkeley, School of Law in 1990, where he was Order of the Coif, and a B.S. in Aeronautical Operations from San Jose State University in 1987, graduating as a President's Scholar. He is admitted to the State Bar of California and is a Registered Foreign Attorney in Taiwan.
