Robert Gaybrick

Robert Gaybrick is a founding partner at PV Law LLP, where his patent litigation practice spans over 40 years, focusing on electrical, computer, semiconductor, display, automotive, and mechanical technologies. He also provides strategic counsel on intellectual property (IP) licensing, patent procurement, and portfolio development. Prior to co-founding PV Law LLP in 2020, Gaybrick was a partner and the founder of the patent practice at Morgan Lewis & Bockius LLP and previously a partner at Finnegan, Henderson, where he led the electrical and computer practice group and established the firm's presence in Japan. His career also includes serving as a technical adviser to the Court of Customs and Patent Appeals.

Gaybrick primarily works with U.S. and Asian companies, representing both patent owners in leveraging their rights and entities accused of infringement in mounting defenses. His firm's work involves patent litigation in federal courts across the United States, including frequently in "patent litigation hotbeds" like Delaware, Texas, Virginia, and California, as well as appeals to the Federal Circuit. He has participated in over 200 patent licensing negotiations and transactions, including one computer-related IP licensing agreement valued at more than $150 million.

In a notable case, Robert Gaybrick appeared as counsel of record for the plaintiff in Staton Techiya, LLC et al. v. Samsung Electronics Co., Ltd. et al., where Staton Techiya sought approximately $500 million in damages for alleged infringement of patents related to smartphones and AI applications. In May 2024, the court held that Techiya's patent infringement claims were unenforceable against Samsung due to an "unclean hands" defense. A Federal Circuit cross-appeal concerning an audio recording patent in the same dispute was voluntarily dismissed by joint stipulation.

Gaybrick is also active in proceedings before the U.S. Patent and Trademark Office's Patent Trial and Appeal Board (PTAB) and advises on Section 337 investigations before the US International Trade Commission. He was recognized by Patexia Insights as a Top 250 Best Performing Attorney for the PTAB in 2023. He is admitted to the District of Columbia Bar and registered with the U.S. Patent and Trademark Office. He holds a J.D. from Catholic University of America, Columbus School of Law, and a B.S. in Electrical Engineering and Computer Science from Michigan State University.
