Robert A. Auchter

Robert A. Auchter is a highly experienced patent litigator with over two decades of practice, specializing in a broad array of technology sectors including aerospace technology, medical devices, software, networking, telecommunications, polymer technology, and semiconductor processing. His technical background as a software and electrical engineer provides a strong foundation for handling scientifically complex litigation. He also possesses experience in related intellectual property matters such as trade secret misappropriation, trademark, copyright, and DMCA litigation.

Auchter has a diverse practice, representing both plaintiffs and defendants in patent disputes. While tracked appearances show a slightly higher incidence on the plaintiff side (2 plaintiff, 1 defendant), his firm, BC Law Group, P.C., emphasizes high-value patent enforcement and has a track record of significant recoveries. He is currently Counsel at BC Law Group, P.C., and has also practiced under Auchter PLLC. Earlier in his career, he was associated with McKool Smith, P.C.

Auchter is actively involved in Patent Trial and Appeal Board (PTAB) proceedings, representing both petitioners and patent owners. He is currently counsel for Foras Technologies Ltd., the patent owner, in the ongoing BMW of North America, LLC v. Foras Technologies Ltd. IPR proceedings (IPR2024-01346 and IPR2024-01347). He has also served as backup counsel for BMC Software, Inc. in IPR2015-01631 and as Of Counsel for Auchter PLLC in IPR2023-00080. His experience includes arguing before the U.S. Court of Appeals for the Federal Circuit.

He earned his B.S., cum laude, in Electrical Engineering from George Washington University in 1989 and his J.D., with High Honors, from George Washington University Law School in 1993. Auchter is admitted to practice in the District of Columbia, before the U.S. Court of Appeals for the Second, Ninth, and Federal Circuits, the U.S. Court of Federal Claims, and the U.S. Patent and Trademark Office.
