Richard S.J. Hung

Richard S.J. Hung is a highly experienced patent litigator and Global Co-Chair of Morrison & Foerster's Litigation Department, where he also previously co-led the firm's Intellectual Property Litigation Group for over a decade. His practice spans a diverse range of advanced technologies, including software, cryptography, semiconductors, consumer electronics, and medical devices. This includes experience with internet search, programmable logic devices, graphical user interfaces, and smartphones.

Hung primarily focuses on defending operating companies in high-stakes patent disputes. Out of eight tracked appearances, seven have been on the defendant side, often representing major technology firms against non-practicing entities (NPEs). Notable defendant representations include Apple Inc., VIZIO, Inc., Symantec Corp., Microsoft Corp., Nissan Motor Co., Ltd., and CrowdStrike, Inc. He has also represented plaintiffs in competitor-on-competitor cases, such as Fortinet, Inc. v. Palo Alto Networks, Inc.

Throughout his career, Hung has tried over a dozen cases to verdict or final award and managed more than 150 IP matters. Key outcomes include winning summary judgment of non-infringement for Yahoo! in Augme Technologies LLC v. Yahoo!, Inc., which was affirmed on appeal, and securing consent judgments of patent infringement in Medtronic Spine LLC v. Cozmed, LLC. He was also involved in a high-profile smartphone case that resulted in a jury verdict. His experience extends to adversarial proceedings before the Patent Trial and Appeal Board (PTAB), where he regularly represents clients in inter partes review (IPR) proceedings.

Hung earned dual bachelor's degrees in electrical engineering and economics from Stanford University and his Juris Doctor from Columbia Law School. He is admitted to practice in California and before the U.S. Patent & Trademark Office. After law school, he clerked for the Honorable Paul R. Michel of the U.S. Court of Appeals for the Federal Circuit.
