Richard G. Frenkel

Richard G. Frenkel is a patent litigation partner at Latham & Watkins. His practice focuses on representing clients in complex intellectual property disputes across a range of high-technology sectors, including telecommunications, internet and digital media, information technology, software, and semiconductors. Before entering private practice, Frenkel was the Director of Intellectual Property for Consumer and Emerging Technologies at Cisco Systems and worked as an aerospace engineer. His career has also included a partnership at Wilson Sonsini Goodrich & Rosati. The authoritative case list shows a strong preference for defense-side work, with five of his six tracked appearances representing defendants.

The tracked cases highlight his role as lead counsel for defendants including fuboTV and DirecTV in litigation brought by DISH Technologies. Beyond these matters, his representative work includes obtaining a summary judgment of patent ineligibility for Amazon in a case brought by Eolas, which was affirmed on appeal, and successfully defending NVIDIA at trial against Samsung. Frenkel also has significant experience with post-grant proceedings before the Patent Trial and Appeal Board (PTAB), having used inter partes review (IPR) to invalidate patents asserted against clients such as Amphenol and Arista Networks.

Mr. Frenkel earned his J.D. from Loyola Law School, a B.S. from the University of Michigan, and an M.S. from the Massachusetts Institute of Technology. He is an active member of the State Bar of California.
