Reuben H. Chen

Reuben H. Chen is a highly experienced patent litigation partner at Cooley LLP, where he has practiced since 2003. His practice spans a broad range of technologies, including artificial intelligence, communications, mobile and web technologies, and medical devices and biotechnology.

Mr. Chen primarily represents defendants, frequently defending operating companies against patent infringement lawsuits brought by non-practicing entities and competitors. All four of his tracked appearances are on the defendant side, where he has served as lead counsel. His notable successes include winning a motion to invalidate all asserted claims for Uber based on unpatentable subject matter, and securing dismissal with prejudice for BitTorrent and eero in patent cases. He also led a team that secured a dismissal with prejudice for NETGEAR in a patent infringement suit.

Among his significant cases, Mr. Chen defended against eDekka LLC, a prolific patent assertion entity, where the asserted patent was ultimately invalidated, leading to the court finding the case exceptional and opening the door for defendants to seek attorneys' fees. He has also been involved in the ongoing competitor litigation of Beckman Coulter, Inc. v. Cytek Biosciences, Inc., a case involving medical devices, where Cytek Biosciences has pursued post-grant challenges. Furthermore, Mr. Chen has a strong record in PTAB proceedings, including successfully invalidating challenged claims for Snap Inc. before the Patent Trial and Appeal Board (PTAB), a victory affirmed by the Federal Circuit. He also secured a summary judgment win for CoolIT across the district court and the PTAB, which was affirmed at the Federal Circuit.

Mr. Chen earned his J.D. from Stanford Law School in 2003 and a B.A. summa cum laude from the University of Pennsylvania in 1998. He was admitted to the State Bar of California in December 2003.
