R. David Donoghue

R. David Donoghue is a partner and the nationwide leader of Holland & Knight's Intellectual Property Practice Group, based in Chicago. His patent litigation practice is diverse, spanning technology areas such as 3G/4G/LTE telecommunications standards, medical devices, automotive technologies, software, internet technologies, WiFi, pharmaceuticals, and retail product manufacturing. He frequently counsels retail and supply chain clients, often defending them against non-practicing entities (NPEs), and has extensive experience with Standards Essential Patents (SEPs). Before joining Holland & Knight in 2008, Mr. Donoghue was a founding member of the Technology Licensing and Litigation team at Delphi Technologies.

While Mr. Donoghue works both sides of patent disputes, his practice includes a significant focus on defending operating companies. He has served as trial counsel for defendants in cases such as Pointwise Ventures LLC v. YOOX Net-a-Porter Group SpA. He has achieved notable defense victories, including arguing successfully before the Federal Circuit on behalf of Boston Proper, Nike, Aeropostle, and Dick's Sporting Goods, affirming an early summary judgment of noninfringement against a patent assertion entity. Mr. Donoghue has also secured early dismissals by invalidating software patents through Rule 12 motions, which were subsequently affirmed by the Federal Circuit. On the plaintiff side, he has obtained a full jury verdict, including findings of willfulness, trebled damages, and an award of attorney's fees for a manufacturing client against a competitor.

Mr. Donoghue has a strong track record as lead trial counsel in patent disputes across district courts, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Patent Trial and Appeal Board (PTAB).

He earned his B.S.E. in Aerospace Engineering, magna cum laude, from the University of Michigan and his J.D., cum laude, from Georgetown University Law Center. He is admitted to practice in California, Illinois, and Michigan, as well as before the U.S. Patent and Trademark Office and the Federal Circuit, among other federal courts.
