Peter Tong

Peter Tong is a patent litigation partner at Russ August & Kabat, where he leads the firm's Dallas office in Texas, which opened in March 2023. His practice emphasizes intellectual property litigation, particularly in the Western District of Texas, where he previously served as a law clerk to Judge Alan D. Albright. Tong works on behalf of both plaintiffs and defendants in federal courts and has a stated interest in building a patent plaintiff contingency practice.

His technical expertise spans a broad range of areas, including computer architecture, memory design, analog and digital circuits, processors, online searching and advertising, software, semiconductor fabrication, cooling systems, power devices, server systems, mobile devices, semiconductor materials, and wireless communications. In recent matters, he has served as lead counsel for Ingeniospec LLC, a non-practicing entity, in a patent infringement case against Meta Platforms, Inc., concerning patents related to activity-monitoring hardware in wearable headsets and electronic eyewear. Ingeniospec has reached settlements with major technology companies, including Meta, HTC, ByteDance, and Samsung, over electronic eyewear and earbud technology. Tong also represented Resonant Systems Inc. as counsel in defense against Apple Inc. in a case involving haptic feedback devices. He has contributed to securing a jury verdict worth hundreds of millions of dollars for a client.

Tong also possesses significant experience with inter partes review (IPR) proceedings before the USPTO, having secured wins in such actions. The Apple Inc. v. Resonant Systems Inc. matter involved related IPR proceedings where claims were invalidated. In addition to patent litigation, his practice includes matters concerning the theft of trade secrets and breach of confidentiality.

Peter Tong is admitted to practice in Texas and California, as well as before the U.S. Patent and Trademark Office. He earned his J.D. from the University of Texas at Austin in 2014 and his B.S.E.E., summa cum laude, from the University of Texas at Dallas in 2010.
