Specialty & background

Perry Mark Goldberg is a founding and Managing Partner at Progress LLP, where his practice focuses on intellectual property litigation, with an emphasis on patent litigation. His professional journey includes co-founding Goldberg, Lowenstein & Weatherwax LLP, and serving as a partner for many years at Irell & Manella LLP.

Mr. Goldberg primarily represents patent holders, as evidenced by his appearance as Lead Counsel for the plaintiff in Kannuu Pty Ltd. v. Samsung Electronics Co., Ltd. et al.. His experience spans a range of technologies, including remote control search-and-navigation technology, digital video recorders, internet telephony, plasma televisions, and pharmaceuticals.

He has been involved in several prominent patent litigation matters. Notably, he represented TiVo Inc. in TiVo Inc. v. EchoStar Communications, Inc., a case involving DVR technology where a jury found willful infringement, ultimately leading to a settlement of $500 million in addition to a prior $100 million judgment. He was also a member of the team representing Stac Electronics in Stac Electronics v. Microsoft, which resulted in a $120 million jury verdict and a worldwide injunction that led to a swift settlement. In Kannuu Pty Ltd. v. Samsung Electronics Co., Ltd. et al., Mr. Goldberg acted as Lead Counsel for Kannuu, which involved asserting patent infringement claims against Samsung. This case also addressed attempts by Kannuu to enjoin Samsung's inter partes review (IPR) petitions at the Patent Trial and Appeal Board (PTAB), a motion that was denied by the district court and affirmed on appeal by the Federal Circuit. He also handled arguments in both district court and on appeal to the Federal Circuit for TiVo Inc. in Pause Technology v. TiVo Inc., securing summary judgment of non-infringement that was affirmed.

Mr. Goldberg was admitted to practice in California in 1993. He earned his B.S. in economics, summa cum laude, from the University of Pennsylvania (Wharton School of Business) in 1990, and his J.D., cum laude, from Harvard Law School in 1993, where he served as Editor of the Harvard Journal of Law & Technology.
