Omar A. Khan

Omar A. Khan is a highly regarded patent litigator specializing in complex, high-stakes intellectual property matters for leading technology and life sciences companies. His practice encompasses a broad range of industries, including biopharma, medical devices, diagnostics, genomics, computer hardware and software, telecommunications, and financial services. Notably, the case Beckman Coulter, Inc. v. Cytek Biosciences, Inc., where he serves as lead counsel for the plaintiff, involves patents related to flow cytometers, aligning with his background in medical devices and biotechnology. His prior experience as a Patent Examiner at the USPTO focused on medical devices, diagnostics, and biotechnology applications.

Mr. Khan demonstrates a balanced practice, representing both plaintiffs and defendants in patent disputes. His tracked appearances include one case on the plaintiff side as lead counsel and one on the defendant side as a pro hac vice attorney. His experience also extends to Inter Partes Review (IPR) and Post-Grant Review (PGR) proceedings before the Patent Trial and Appeal Board (PTAB), as well as ITC proceedings. He has served as pro hac vice counsel in IPRs involving microfluidic devices and contributes to publications on Federal Circuit patent updates and IPRs.

Mr. Khan earned his J.D. from Columbia Law School in 2006, an M.S. in Electrical Engineering from Johns Hopkins University in 2003, and a B.S. in Biomedical Engineering from Johns Hopkins University in 2001. He is admitted to the New York Bar and practices before the U.S. Supreme Court, multiple U.S. Courts of Appeals (Federal, Second, Sixth, Ninth Circuits), and several U.S. District Courts.
