Nick Cerrito

F. Dominic "Nick" Cerrito is a highly experienced patent litigator with a strong focus on the pharmaceutical and life sciences industries, currently serving as the Global Head of Quinn Emanuel Urquhart & Sullivan's Life Sciences Practice. His practice primarily involves Hatch-Waxman litigation, navigating the intersection of patent and FDA laws, and includes client counseling, due diligence for pharmaceutical product acquisitions, strategic planning, and patent prosecution strategies. He has litigated a diverse array of products across therapeutic classes such as anti-cancer, central nervous system, analgesics, anti-hypertensive, and gastrointestinal products.

Throughout his career, Mr. Cerrito has predominantly represented innovator pharmaceutical companies, established biotechnology firms, and start-ups, aligning with his single tracked plaintiff-side appearance in Merck v. Apotex Inc. et al. While primarily working on behalf of patentees, he also notably served as co-lead trial counsel, successfully representing the sole defendant to prevail in the first-wave Prilosec® litigation. Before joining Quinn Emanuel in 2012, where he became a partner, Mr. Cerrito was an intellectual property lawyer at Jones Day, and previously at Pennie & Edmonds LLP.

His notable representations include serving as lead counsel for the patentees of high-revenue products like Revlimid®, as well as Abraxane®, Xyrem®, and Pomalyst®. His extensive experience also covers cases involving drugs such as Namenda®, Altace®, Avinza®, Oxycontin®, and Sonata®. Mr. Cerrito's practice extends to Post-Grant Review (PGR) proceedings before the Patent Trial and Appeal Board (PTAB), including Inter Partes Reviews (IPRs) and Covered Business Method (CBM) reviews.

Mr. Cerrito earned his J.D. from New York Law School and holds a B.S. in Chemistry from Case Western Reserve University. He is admitted to the State Bar of New York and has appeared before the United States Court of Appeals for the Federal Circuit.
