Neil Alan Rubin

Neil Alan Rubin is a partner at Russ August & Kabat, specializing in intellectual property and patent litigation. His practice focuses on patent, trade secret, and other intellectual property disputes for clients across computer security, networking, electronics, software, and financial industries. His technical background includes physics degrees and research in solid state physics, which complements his work in complex technology-driven cases.

With a clear preference for representing patent owners, Rubin primarily operates on the plaintiff side, with 7 out of 8 tracked appearances being for plaintiffs. His firm highlights his role within the plaintiff's patent infringement litigation department. He has contributed to clients recovering over $1.7 billion in judgments and settlements. Notable plaintiff-side engagements include his representation in Headwater Research LLC v. T-Mobile USA, Inc. et al., VirtaMove Corp. v. Hewlett Packard Enterprise, and Wilus Institute of Standards and Technology Inc. v. HP Inc.. In Headwater Research, a jury initially awarded $175 million in patent infringement damages against Verizon, though the verdict was later dismissed.

Rubin joined Russ August & Kabat in 2016, following a decade at Latham & Watkins as a member of their Intellectual Property Litigation practice group. He possesses experience litigating patent matters in district courts, before the International Trade Commission, and before the Patent Trial and Appeal Board (PTAB). He has appeared as counsel for patent owners in IPR proceedings, including for Headwater Research LLC.

He is admitted to the State Bar of California (2007) and registered with the U.S. Patent and Trademark Office (2010). Rubin earned his J.D. from Stanford University Law School (2006) and holds multiple physics degrees, including an M.S. from Stanford, an M.Phil. from Cambridge University as a Churchill Scholar, and a B.S., summa cum laude, from Case Western Reserve University.
