Nathaniel DeLucia

Nathaniel DeLucia is an intellectual property litigation partner at Kirkland & Ellis LLP, focusing his practice primarily on patent infringement and trade secret disputes in U.S. Federal Courts and at the International Trade Commission. He handles a broad array of technologies, including pharmaceuticals, high-tech devices, and consumer products, with notable experience in mechanical and industrial design patents as well as connected fitness technology. His litigation profile indicates a strong emphasis on defending operating companies, consistent with his tracked appearances as defense counsel in all reported matters.

Before joining Kirkland & Ellis, Mr. DeLucia gained experience at Weil, Gotshal & Manges. He is also active in post-grant proceedings before the Patent Trial and Appeal Board (PTAB), having been recognized to appear pro hac vice in multiple inter partes review (IPR) proceedings. This includes assisting with IPRs in the Klein Tools litigation and previously securing a significant PTAB win where an opposing party disclaimed patent claims.

Mr. DeLucia has been involved in several prominent cases, including representing Klein Tools Inc. against Milwaukee Electric Tool Corp. in patent infringement disputes concerning modular storage systems and tape measures, where at least one district court case was voluntarily dismissed. He successfully represented Frymaster, a Welbilt company, in patent litigation involving fryer technology, obtaining a district court stay and a favorable PTAB outcome. Additionally, he represented Heineken in a Section 337 investigation at the ITC, where it was found that Anheuser-Busch InBev's beverage dispensing system infringed Heineken's patent. He also handled complex patent infringement, unfair competition, and false advertising claims for iFIT Inc. against Peloton Interactive, Inc. related to connected fitness technology, which concluded in a confidential settlement.
