Michael Shen

Michael Shen is a seasoned patent litigation attorney currently serving as Director and Chief Counsel of Patent Litigation at Taiwan Semiconductor Manufacturing Company (TSMC), a role he has held since March 2014. His practice is primarily focused on defending operating companies against patent infringement allegations, particularly within the complex field of semiconductor devices and manufacturing technology, aligning with TSMC's core business. Prior to his in-house role, Mr. Shen developed his litigation expertise as an IP Litigation Partner at Haynes and Boone, LLP, and Kenyon & Kenyon LLP, and as an Associate at Sughrue Mion PLLC.

Mr. Shen's experience includes actively managing and strategically navigating complex patent disputes. He has appeared in federal district court cases, consistently on the defendant side, representing TSMC against assertions of patent infringement. The named case of Longitude Licensing Limited et al. v. Lenovo Group Limited et al., where TSMC is a defendant, exemplifies his involvement in significant litigation concerning semiconductor devices and manufacturing technology. This case was notably stayed pending an International Trade Commission (ITC) determination, indicating a multi-forum litigation strategy.

He is highly experienced with Patent Trial and Appeal Board (PTAB) proceedings, viewing Inter Partes Reviews (IPRs) as a critical component of patent litigation defense. Under his leadership, TSMC has extensively utilized IPRs to challenge patent validity, demonstrating a strong track record in defending against asserted patents before the PTAB. Mr. Shen has also engaged in policy discussions regarding PTAB rules, advocating for the ability of manufacturers like TSMC to utilize IPRs effectively.

Mr. Shen earned his Juris Doctor (J.D.) from Georgetown University Law Center in 1998 and holds a Bachelor of Science (B.S.) in Chemical Engineering from the University of Michigan, awarded in 1995. He is admitted to practice in California.
