Michael Jason Riesen

Michael Jason Riesen is an experienced patent litigation attorney with a strong technical background, currently serving as a Partner and Atlanta Section Head of the Intellectual Property practices at Smith, Gambrell & Russell, LLP. He also holds the role of Executive Director of SGR Labs. Previously, he was a Partner in the IP Practice at another national law firm, which included an appearance as lead counsel for Banner Witcoff. He joined Smith, Gambrell & Russell in April 2019.

Mr. Riesen's practice focuses on intellectual property and litigation, technology transactions, fintech, digital assets, and emerging company strategy. Leveraging a technical background in physics, materials science, electrical engineering, computer science, and artificial intelligence, he manages patent portfolios and litigation across diverse technologies, including optics, medical devices, image processing, Internet-of-Things (IoT), data science analytics, merged reality, telemedicine, plastics, and material science. He is a registered U.S. patent attorney and a U.K. Solicitor (England and Wales).

In patent litigation, Mr. Riesen primarily defends operating companies. His tracked case history shows two appearances on the defendant side, including serving as lead counsel. He has been involved in dozens of patent suits, including challenging validity under 35 U.S.C. § 101 at the District Court and on appeal to the Federal Circuit. His notable tracked case, Earin AB v. Audio-Technica U.S., Inc., involves patent infringement defense related to wireless audio technology.

Mr. Riesen possesses significant experience with PTAB and EPO proceedings, having been involved in more than 20 such matters. He has prepared and filed petitions for inter partes review (IPR) at the USPTO, particularly for clients in the optics, imaging, and photonics technology sectors. Admitted to practice in Florida, Ohio, and Georgia, he is also admitted to the U.S. Court of Appeals for the Federal Circuit and the U.S. Patent and Trademark Office. He earned his B.S. in Physics from Clarion University of Pennsylvania, an M.S.E. in Engineering (Machine Learning) from the University of Toledo, and his J.D., cum laude, from the University of Toledo College of Law.
