Specialty & background

Michael J. Lyons is a highly experienced patent litigator with over 25 years in intellectual property rights practice, currently a partner and leader of the Silicon Valley litigation practice at Morgan, Lewis & Bockius LLP. His practice spans a diverse range of technologies, including video streaming, consumer electronics' circuit architecture, medical devices, semiconductor processing, software, optoelectronic transceivers, ink jet and laser printers, hard disk drives, hardware for graphics image production, and wireless networking.

Mr. Lyons demonstrates a balanced practice, representing both plaintiffs and defendants in high-stakes patent disputes. His notable plaintiff-side successes include securing a $268 million verdict for the Alfred E. Mann Foundation in a patent infringement action against Cochlear, which doubled a prior jury verdict for willful infringement. He also achieved a recovery exceeding $250 million for ActiveVideo Networks in a case involving video-on-demand technology and obtained an exclusion order in a US International Trade Commission (ITC) investigation for a leading light-emitting diode manufacturer. On the defense side, Mr. Lyons served as Local Counsel in eDekka LLC v. Sally Beauty Supply LLC, a patent infringement suit where the patent-in-suit was ultimately deemed invalid under 35 U.S.C. § 101, leading to the dismissal of numerous cases brought by the patent assertion entity eDekka. Early in his career, he also appeared as lead counsel for the plaintiff in Sampo IP, LLC v. Ambit Energy Holdings, LLC et al. with T-Squared Law.

Beyond district court litigation, Mr. Lyons is active in adversarial Patent Office proceedings, frequently handling inter partes reviews (IPRs), post-grant reviews (PGRs), and ex parte reexaminations. He successfully obtained Federal Circuit affirmance of termination rulings in four Covered Business Method (CBM) review proceedings in 2015.

Mr. Lyons earned his J.D. from Georgetown University Law Center in 1992 and a B.S. from Pennsylvania State University in 1989. He is admitted to practice in California, New York, and before the US Patent and Trademark Office.
