Michael C. Pomeroy

Michael C. Pomeroy is a patent litigation attorney with a focus on intellectual property and commercial litigation matters. His practice includes representing both plaintiffs and defendants in patent infringement, copyright infringement, breach of contract, and trade secret disputes. His experience spans various technologies, including electric vehicle charging systems, graphics rendering, near frequency communication, and distributed speech recognition architectures.

Mr. Pomeroy is currently an Associate at Carter Arnett, where he handles intellectual property protection, including patent, copyright, and trade secret litigation. Prior to joining Carter Arnett, he was an Associate at another patent litigation boutique in Dallas. A significant portion of his recent work involves the cases of Charge Fusion Technologies, LLC v. Tesla, Inc. (plaintiff) and Tesla, Inc. v. Charge Fusion Technologies, LLC (defendant). These related matters concern patents related to electric vehicle charging systems, specifically intelligent charging, climate control while charging, and plug-and-charge functionality. These cases have seen activity at the Patent Trial and Appeal Board (PTAB) and appeals at the U.S. Court of Appeals for the Federal Circuit. For example, the Federal Circuit recently affirmed a PTAB decision in Tesla, Inc. v. Charge Fusion Technologies, LLC, finding Tesla did not prove certain claims of U.S. Patent No. 10,998,753 unpatentable, related to a charging system that computes a schedule and increases battery charge accordingly. Mr. Pomeroy has also represented patent owners in IPR proceedings, such as in Aputure Imaging Industries Co., Ltd. v. Rotolight Limited, which terminated due to settlement. He has been recognized as a top PTAB attorney for patent owners based on his success record.

Mr. Pomeroy is a registered patent attorney with the U.S. Patent and Trademark Office. He is admitted to practice in Texas and before the U.S. District Courts for the Northern, Eastern, and Western Districts of Texas, as well as the U.S. Court of Appeals for the Federal Circuit. He earned his J.D. cum laude from SMU Dedman School of Law in 2017, an M.S. in Biology (magna cum laude) from the University of Texas in 2013, and a B.S. in Neurobiology from the University of Texas-Austin in 2011.
