Matthew G. Berkowitz

Matthew G. Berkowitz is a patent litigator at Reichman Jorgensen Lehman & Feldberg LLP (RJLF), where he joined as a partner in June 2023 after launching and leading the intellectual property litigation practice at Shearman & Sterling. His practice encompasses a broad range of technologies, including consumer electronics, memory systems, automotive systems, and software and networking technologies. He frequently handles matters involving wireless communication, such as Wi-Fi, 3G, 4G, and 5G technologies for clients like Malikie Innovations Limited, and has deep experience in financial technology, mobile payments, Near Field Communication (NFC), cryptocurrency, and blockchain, notably representing CardWare Inc.

Berkowitz maintains a balanced practice, representing both plaintiffs and defendants in high-stakes patent disputes. His plaintiff-side work includes leading cases for Malikie Innovations Limited against entities such as Core Scientific, Inc. and Marathon Digital Holdings, Inc., and for CardWare Inc. in its NFC payment technology suits against companies like Apple Inc. and Google LLC. On the defense side, he has acted as lead counsel for operating companies such as Toyota in automotive patent matters, STMicroelectronics in indemnification disputes, and successfully represented musical.ly in a case where he won a motion to dismiss asserted patents as ineligible. He also serves as respondent counsel in post-grant proceedings for clients like CardWare Inc.

He is highly experienced in Patent Trial and Appeal Board (PTAB) proceedings, having acted as lead counsel in over 20 post-grant matters, including inter partes reviews (IPRs). His PTAB experience includes successfully challenging patents for clients such as Toyota, where petitions were granted on all 50 combined claims across five IPRs, and for US Endodontics, invalidating all asserted claims. Berkowitz has also successfully argued multiple matters before the U.S. Court of Appeals for the Federal Circuit, securing a precedential opinion in favor of Airbus S.A.S.

Berkowitz earned his J.D., cum laude, from Temple University and holds a B.S. in Industrial Engineering from Pennsylvania State University. He is admitted to practice in California and New York, and before the U.S. Courts of Appeals for the Federal and Ninth Circuits, as well as multiple U.S. District Courts.
