Matthew D. Aichele

Matthew D. Aichele is a Partner at Russ August & Kabat, where he chairs the firm's International Trade Commission (ITC) Practice, specializing in intellectual property litigation with an emphasis on ITC matters and federal district court patent infringement actions. His technical background includes a Scientiae Baccalaureus (SB) in Nuclear Engineering from the Massachusetts Institute of Technology, where he also worked as a senior reactor operator. This technical expertise underpins his practice, which spans high-technology areas such as AMOLED display panels, networking devices, touch-controlled mobile devices, smart thermostat systems, data transmission devices, wireless audio, and AR/VR headsets.

Aichele demonstrates experience representing both plaintiffs and defendants in patent disputes. While his tracked case, Ingeniospec LLC v. Snap Inc., shows him representing a plaintiff in a matter involving AV1 and HEVC video codecs, his professional background also includes representing complainants and respondents in numerous ITC investigations. Before joining Russ August & Kabat, Mr. Aichele was an attorney in the Intellectual Property group at Latham & Watkins LLP. Notable matters he has handled or contributed to at Russ August & Kabat include representing EcoFactor in securing significant jury verdicts against Google ($20 million) and ecobee ($5.4 million) related to smart thermostat and energy-saving HVAC controllers, with the Google verdict affirmed by the Federal Circuit. While his practice primarily focuses on ITC and federal district court litigation, his firm is recognized for its patent litigation practice, including experience in Patent Trial and Appeal Board (PTAB) proceedings, having represented a patent owner in a victory in an inter partes review.
