Mark D. Fowler

Mark D. Fowler is a seasoned patent litigation trial lawyer with over three decades of experience, currently serving as a Partner and Member of the Global Board at DLA Piper. He is also the global co-chair of the firm's Intellectual Property and Technology practice. His practice primarily focuses on representing high-profile technology companies in complex patent disputes before U.S. district courts, the Federal Circuit, and the International Trade Commission (ITC).

Mr. Fowler predominantly works on the defendant side, defending major technology corporations against infringement claims. His expertise spans a broad range of technologies, including semiconductor memory chips, consumer electronics, software registration and activation systems, live streaming technology, wireless communication, and web browser interactive content. Notable defense engagements include representing Toshiba against Intellectual Ventures, securing a jury verdict of non-infringement and invalidity for the asserted patents, and achieving favorable outcomes for Samsung in ITC and district court litigation initiated by Technology Properties Limited (TPL). He also successfully defended a multinational technology company against a US$500 million patent infringement claim related to live streaming technology.

His experience includes significant involvement in post-grant proceedings, having utilized Inter Partes Reviews (IPRs) to narrow cases, such as in the Intellectual Ventures v. Toshiba litigation. In the tracked case, Uniloc USA, Inc. v. Sega of America, Inc., where he appeared as of counsel for the defendant, the asserted software registration patent was found unpatentable in IPR proceedings, a decision later affirmed by the Federal Circuit. He is recognized for his performance in both ITC and patent litigation, being named among the Top 100 Overall Best-Performing ITC Attorneys Representing Respondents and Patent Litigators by Patexia in 2026.

Mr. Fowler earned his J.D. from Stanford University in 1986 and his A.B. from the University of California at Berkeley in 1983. He is admitted to practice in California.
