Marc A. Fenster

Marc A. Fenster is a first-chair trial lawyer and the chair of the Patent Litigation department at Russ August & Kabat, where he has built a practice focused on representing patent owners in high-technology disputes. His work primarily involves complex technologies, including wireless communications, data encryption and compression, mobile camera and image processing, and targeted internet advertising. The authoritative case list and a review of his broader public record show a consistent practice of representing plaintiffs against large, established technology companies.

Mr. Fenster's career is marked by a string of high-value jury verdicts for his clients. He has secured significant awards as lead counsel in numerous cases, including verdicts against Western Digital ($262 million and $315 million in separate cases), Samsung ($279 million), Amazon ($122 million), and Google ($20 million). He also led the team that secured a settlement for Corephotonics in a multi-year patent dispute with Apple over mobile camera technology. In the tracked case, Intent IQ LLC v. Viant Technology LLC, Mr. Fenster served as lead counsel for the plaintiff, consistent with his focus on patent assertion.

Mr. Fenster has been with Russ August & Kabat since 2003, when he was hired to establish the firm's patent litigation group. He was previously an attorney in the intellectual property and litigation groups at Irell & Manella LLP from 1995 to 2003. While not his primary focus, Mr. Fenster has experience representing clients in inter partes review (IPR) and other proceedings before the Patent Trial and Appeal Board (PTAB), often in parallel with district court litigation.

He earned his J.D. from the University of California, Los Angeles School of Law in 1995 and also holds a Master's and a Bachelor's degree in Bio-Engineering from the University of California, San Diego.
