M. Scott Stevens

M. Scott Stevens is a highly experienced patent litigator and co-chair of Alston & Bird's Intellectual Property Litigation Group, as well as co-chair of the firm's Section 337 practice before the U.S. International Trade Commission (ITC). His practice spans a diverse range of technologies, including chemicals, chemical manufacturing processes, telecommunications, pharmaceuticals, cloud computing, optical communications, and sonar technology. Stevens also has experience in trademark, trade secret, and copyright litigation.

Stevens exhibits a balanced practice, representing clients as both plaintiffs/complainants and defendants in patent infringement matters. His tracked appearances reflect two plaintiff-side cases and one defendant-side case. He is particularly active in ITC Section 337 investigations, where he represents both complainants and respondents. Notable defense work includes securing a complete defense verdict for T-Mobile and Ericsson against a $253 million patent infringement claim in the Eastern District of Texas concerning base station equipment, and obtaining a rare defense summary judgment for Alcatel-Lucent in the same district in fiber-optic communications litigation. On the plaintiff side, he was lead counsel for Navico in litigations against Garmin, resulting in a $38.7 million jury verdict, a limited exclusion order, and the largest-ever recommended civil penalty by the ITC at $37 million for sonar technology. He also secured an exclusion order for Universal Electronics Inc. against Roku, which was affirmed by the Federal Circuit.

Beyond district court and ITC proceedings, Stevens represents patent owners and petitioners in inter partes reviews (IPRs) before the Patent Trial and Appeal Board (PTAB). He has also argued before the U.S. Court of Appeals for the Federal Circuit on multiple occasions.

Stevens earned his J.D. (2003) and B.S. (2000) from the University of Virginia. He is admitted to practice in North Carolina, the District of Columbia, Virginia, and before the U.S. Patent and Trademark Office.
