Specialty & background
Kal K. Shah is a prominent patent litigator and the Chair of Benesch Friedlander Coplan & Aronoff's Intellectual Property Litigation Group. His practice encompasses a broad range of intellectual property disputes, including patent, copyright, trademark, and trade secret matters. Leveraging a background as a former engineer at Abbott Laboratories with degrees in bioengineering and chemistry, Mr. Shah possesses deep technical expertise, enabling him to handle complex patent cases across diverse scientific disciplines such as medical devices, computer science and internet applications, bioengineering products, chemical substances, semiconductors, lighting circuits and systems, mechanical devices, and wireless technologies.
Mr. Shah maintains an active trial practice, representing both plaintiffs and defendants in high-stakes patent litigation. While the tracked case list shows an appearance on the defendant side, his firm profile explicitly states he has successfully handled multi-million dollar trials for clients on both sides. Notably, he served as counsel for ASUSTek Computer, Inc. in Force MOS Technology v. ASUSTek Computer, Inc. et al., a case where a Texas jury ordered ASUSTek to pay $10.5 million for infringing chip technology patents, with a finding of willful infringement. Conversely, he secured a $17 million jury verdict for Gamon Plus, Inc. as plaintiff in a patent infringement dispute against Campbell Soup Company. He also successfully defended Feit Electric against patent infringement claims by a Japanese conglomerate, resulting in a jury verdict of no infringement.
His experience extends to post-grant proceedings, as evidenced by his role as counsel for Petitioner Deere & Company in Gramm et al. v. Deere & Company (IPR2015-00899). This experience complements his district court litigation work, which often involves the interplay between inter partes reviews and federal court proceedings.
Mr. Shah earned his J.D., cum laude, from Loyola University Chicago School of Law in 2001, and a B.S. in Bioengineering with a Chemistry minor from the University of Illinois in 1995. He is admitted to practice in Illinois and before the U.S. Patent & Trademark Office, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Courts of Appeals for the Seventh and Ninth Circuits. He began his legal career at Kirkland & Ellis LLP and subsequently practiced at Thompson Coburn LLP and Locke Lord before joining Benesch Friedlander Coplan & Aronoff.
