Joseph R. Falcon, III

Joseph R. Falcon, III is an experienced intellectual property attorney with a comprehensive practice encompassing patent, trademark, trade secret, and copyright law. His litigation experience includes asserting patent rights against infringers, and he also provides strategic counsel on patent prosecution, licensing, validity and infringement studies, and developing robust IP portfolios. His background in Material Science and Engineering suggests an aptitude for technically complex subject matter.

While his tracked appearance as "of counsel" in eDekka LLC v. Sally Beauty Supply LLC shows involvement on the plaintiff side, this particular case resulted in a dismissal with prejudice for the plaintiff's claims, with the court noting the patent was "demonstrably weak" and awarding attorneys' fees to the defendants. Currently, Mr. Falcon is a Partner and Co-chair of the Intellectual Property Practice Group at Barley Snyder, where his work includes both defending and challenging patent validity in various proceedings.

Mr. Falcon possesses significant experience in post-grant proceedings, including those before the U.S. Patent and Trademark Office (USPTO), and is well-versed in challenging or defending the validity and scope of existing patents.
