Joseph Michael Mercadante

Joseph Michael Mercadante is an experienced patent litigator currently serving as a Partner at Fabricant Rubino Lambrianakos LLP (formerly Fabricant LLP). He focuses on patent disputes within the electronics sector, encompassing computer hardware and software, automotive technologies, telecommunications, networking, and semiconductors. His practice also extends to LED display panels and lighting.

Mercadante primarily represents patent owners, including in litigation campaigns involving semiconductors, cellular base stations, and video codecs. He has served as counsel for Advanced Coding Technologies LLC in litigation campaigns concerning video codecs, which includes the tracked PTAB case against Unified Patents. The firm he belongs to generally represents plaintiffs in high-stakes disputes and champions innovators against large corporations.

He possesses significant experience in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB), having been involved in the defense of multiple IPRs for various clients, including as lead counsel in four IPRs for Harbor Island Dynamic LLC. Mercadante litigates patent disputes across various U.S. district courts, including the Eastern District of Texas, Northern and Central Districts of California, and the District of Delaware, as well as in the International Trade Commission.

Joseph Mercadante earned his J.D. from Seton Hall University School of Law in 2009 and holds a B.S. in Electrical Engineering from Villanova University (2006). He is admitted to practice in New York, New Jersey, and before the U.S. Patent and Trademark Office. He also served as a law clerk to Chief Judge Garrett E. Brown Jr. (Ret.) of the U.S. District Court for the District of New Jersey.
