Specialty & background

Joseph M. Drayton is a highly experienced first-chair trial lawyer specializing in intellectual property litigation, particularly patent disputes, across diverse technology sectors. His practice encompasses medical devices (such as plasmapheresis and spinal fusion technologies), cellular and broadband connectivity standards (e.g., LTE), semiconductor chips, video transmission and streaming systems, and financial technology related to stored value card networks. Drayton's work also extends to trade secrets, copyright, trademark, trade dress, and false advertising matters, and he advises clients on IP acquisition, transfer, protection, and enforcement strategies.

Drayton demonstrates a balanced practice, representing both plaintiffs and defendants, typically for prominent operating companies. While his recent tracked cases show him representing patentee Haemonetics Corporation in medical device patent infringement actions against Terumo BCT, Inc. and Fresenius Kabi USA, LLC et al., he also has significant experience defending major corporations. Notable defense successes include representing Motorola Mobility and a semiconductor chip manufacturer in International Trade Commission (ITC) patent infringement actions, securing successful resolutions or non-infringement findings. He also achieved favorable jury verdicts for Blackhawk Network and Pier 1 Imports in patent suits concerning network systems and gift card technology, respectively.

Currently a partner and co-head of the Patent Law practice at Proskauer Rose LLP, Drayton joined the firm in November 2023. Prior to Proskauer, he practiced at Perkins Coie, where he appeared as of counsel in INVT SPE LLC v. T-Mobile USA, Inc., a case involving LTE networking standards that saw a Federal Circuit affirmation of non-infringement. His experience includes representing a Fortune 100 broadband company before the Patent Trial and Appeal Board (PTAB) regarding data transmission systems, and his publications reflect ongoing engagement with IPR and PTAB proceedings.

Drayton earned his J.D. from the University of Pennsylvania Carey Law School in 1997 and holds a B.S. in Electrical Engineering from the University of Maryland at College Park (1993). He is admitted to practice in New York, Maryland, and the District of Columbia.
