Joseph Evall

Joseph Evall is a litigation partner in the New York office of Gibson, Dunn & Crutcher, focusing on intellectual property, life sciences, and product liability. His practice primarily involves complex science and technology, with a significant emphasis on pharmaceutical, biotech, and chemical patent litigation. He has experience across diverse technology areas, including novel drug substances, microalgae, real-time weather systems, DVR technology, biologics, and chemical processes for mercury control in coal-fired power plants.

Evall predominantly represents defendants in patent infringement matters, as evidenced by his tracked appearances. For instance, he served as lead counsel for defendants in the related cases Midwest Energy Emissions Corp. et al. v. CERT Operations II LLC et al. and Midwest Energy Emissions Corp. et al. v. Arthur J. Gallagher & Co. et al., which involved patents for mercury control technology. While a jury in the District of Delaware awarded Midwest Energy Emissions Corp. a $57 million verdict in March 2024 against some of the defendants in the Arthur J. Gallagher & Co. case, these matters highlight Evall's role in defending companies in technically complex environmental patent disputes. He was also involved in Nalco v. Wisconsin Public Service Corp. and Nalco v. Wisconsin Power and Light Comp., defending against patent infringement suits concerning similar mercury reduction methods.

Beyond these, Evall was co-lead counsel in litigation recognized in 2016 as a significant Hatch-Waxman case. He has also successfully represented defendants in patent lawsuits involving locked nucleic acid (LNA) antisense oligonucleotides, securing dismissals. His experience includes developing patent, litigation, IPR, and regulatory strategies, indicating involvement in inter partes review (IPR) proceedings.

Evall graduated summa cum laude from Harvard College, holds a master's degree in Physical Chemistry from Harvard, and earned his law degree magna cum laude from Harvard Law School. He is admitted to practice in New York.
