Jonathan S. Caplan

Jonathan S. Caplan is a seasoned patent litigation attorney and the U.S. Head of Intellectual Property at Kramer Levin Naftalis & Frankel LLP. His practice encompasses patent litigation, counseling, and prosecution, as well as intellectual property aspects of corporate transactions, including the acquisition, sale, or licensing of IP rights. Mr. Caplan's litigation experience spans a diverse range of technologies, including wireless communications, semiconductor wafer inspection equipment, bio-manufacturing, and interactive gaming.

Mr. Caplan is adept at representing both patent owners seeking to enforce their rights and companies defending against allegations of infringement. His tracked case appearances reflect this versatility, with two instances representing plaintiffs and one for a defendant. Notable engagements include representing WinView IP Holdings, LLC as plaintiff in patent infringement actions against FanDuel, Inc. et al. and DraftKings Inc., both involving interactive gaming technology. He has also defended clients such as Callidus Software, Inc. Other significant representations include successfully defending Sirius XM Radio Inc. in multiple patent infringement actions, leading to dismissals or favorable settlements, and representing patent owners like Seoul Semiconductor and Prism Technologies in actions involving LED technology and wireless network access control, respectively.

Beyond district court litigation and Federal Circuit appeals, Mr. Caplan has extensive experience with post-grant proceedings, handling inter partes review (IPR) and ex parte re-examination proceedings before the U.S. Patent and Trademark Office. He regularly advises clients on freedom-to-operate and patent prosecution matters across various technologies, with a particular focus on biotechnology.

Mr. Caplan earned his B.S. in Electrical Engineering from the University of Pennsylvania in 1986 and his J.D., cum laude, from Temple University Beasley School of Law in 1993. He is admitted to practice in New York (1994), New Jersey (1993), and before the U.S. Patent and Trademark Office (1994).
