Jonathan R. DeFosse

Jonathan R. DeFosse is an Of Counsel specializing in intellectual property litigation, currently with Freshfields Bruckhaus Deringer US. His practice primarily focuses on patent and trade secret disputes across a diverse range of technologies, including software, mobile applications, web technology, video streaming, semiconductors, automotive systems, and geolocation systems. DeFosse typically represents operating companies, with his tracked case appearing on the defendant side.

Throughout his career, Mr. DeFosse has achieved notable litigation outcomes. He represented SAP SE as a defendant in EXPRESS MOBILE, INC. v. SAP SE, a patent infringement suit concerning web and mobile technology. While at a prior firm, he successfully litigated a patent and trade secret dispute in a jury trial, securing an eight-figure damages award, a permanent injunction, and an award of attorneys' fees for his client. He also represented Mercedes-Benz USA LLC and Mercedes-Benz International, Inc. in patent infringement suits related to vehicle sensor and safety systems.

DeFosse is also active in post-grant review proceedings before the U.S. Patent Trial and Appeal Board (PTAB). He has represented clients in Inter Partes Review (IPR) proceedings, including as counsel for Petitioner Netflix, Inc. in an IPR against Broadcom Corporation. He has also represented a manufacturer of semiconductor test probes in patent infringement litigation and related IPR proceedings.

Mr. DeFosse is admitted to practice in California and the District of Columbia, as well as before the U.S. Court of Appeals for the Federal Circuit and several U.S. District Courts. He earned his J.D. from Georgetown University Law Center in 2010 and his B.A. from the University of California, Berkeley, in 2007.
