Specialty & background

Jonathan E. Singer is a seasoned patent litigator with a concentrated practice in intellectual property, particularly excelling in the life sciences sector. He is widely recognized for his work in pharmaceuticals and Hatch-Waxman litigation, leveraging his chemistry background to handle complex drug patent disputes, including those involving biosimilars. While his case history includes appearances across various technology areas, such as consumer mechanical products and general technology defense (e.g., against Intel and HP), his primary emphasis and leadership role at his firm are centered on life sciences. Singer primarily represents operating companies, both asserting and defending patent rights. He has served as Lead Counsel in plaintiff-side cases for patentees such as Baby Jogger, LLC and Solmetex, LLC, while also demonstrating significant experience defending companies against infringement claims and challenging competitor patents.

Currently a Principal in the San Diego office of Fish & Richardson P.C., where he leads the firm's life sciences litigation practice and founded its acclaimed Life Sciences Industry Team in 2001, Singer has dedicated over three decades to litigating for life sciences clients. His notable cases include representing Mayo Clinic as district court and appellate counsel in Prometheus Laboratories v. Mayo Collaborative Services, a landmark case concerning patent eligibility under 35 U.S.C. § 101 that reached the U.S. Supreme Court twice and is considered one of the most important patent decisions of this century. He was also trial counsel for Gilead Sciences, Inc. in Gilead Sciences, Inc. v. Merck & Co., where he successfully led a bench trial to set aside a $200 million jury verdict against his client due to unclean hands, a decision later affirmed on appeal. More recently, he was counsel for Alvotech USA Inc. in a multi-jurisdiction biosimilar dispute over Humira® patents, which resolved in a 2022 settlement involving a license agreement. He also secured a victory for Exela Pharma Sciences, LLC in a Hatch-Waxman suit, successfully stopping PGRs and obtaining a court order finding infringement and validity of Exela's patent claims.

Singer is also active in PTAB (Patent Trial and Appeal Board) and IPR (Inter Partes Review) proceedings, having successfully stopped Post-Grant Reviews for Exela Pharma Sciences and argued and obtained the first-ever invalidity ruling on Humira® patents for petitioner Coherus Biosciences, Inc. at the PTAB. Admitted to the California bar in 1993, he is also admitted to the Supreme Court of the United States and the U.S. Court of Appeals for the Federal Circuit. He earned his J.D. with honors from the University of Chicago Law School in 1992 and holds an A.B. in Chemistry from Dartmouth College (1986).
