John M. Mulcahy

John M. Mulcahy is a patent litigation Partner at Finnegan, Henderson, Farabow, Garrett & Dunner, with over 20 years of experience in all phases of patent law. His practice encompasses litigation before federal district courts and the U.S. International Trade Commission (ITC), client counseling, patent prosecution, and post-grant proceedings before the U.S. Patent and Trademark Office (USPTO). He handles a diverse array of technologies, including semiconductors, integrated circuits, optoelectronics, cellular telephony, computer networking, digital video, switching power supplies, solid-state and fluorescent lighting, unmanned systems, and business methods.

Mr. Mulcahy frequently represents multinational electronics manufacturers in patent disputes, including those involving smartphones, consumer electronics, integrated circuits, and fluorescent lighting. His experience spans developing claim construction positions, validity and infringement arguments, expert witness preparation, and settlement negotiations. In a notable tracked case, he represented Science Applications International Corporation (SAIC) as plaintiff in Science Applications International Corporation (SAIC) v. United States, where SAIC successfully defended against the government's motion to dismiss patents related to heads-up displays and night vision goggles on Section 101 eligibility grounds, allowing the infringement case to proceed.

He possesses extensive experience with Patent Trial and Appeal Board (PTAB) proceedings, including inter partes review (IPR) and reexamination requests, often employing them strategically in conjunction with litigation. A former primary examiner at the USPTO, he has broad knowledge of patent prosecution and has argued before the PTAB on numerous occasions.

Mr. Mulcahy earned his B.S. from Pennsylvania State University in 1993 and his J.D., magna cum laude and Order of the Coif, from Georgetown University Law Center in 2005. He was elected partner at Finnegan, Henderson, Farabow, Garrett & Dunner, effective January 1, 2014.
