John LeRoy

John S. LeRoy is a highly experienced patent litigation attorney, serving as a Shareholder and member of the Executive Committee at Brooks Kushman P.C., which he joined in 1999. His practice spans high-stakes intellectual property disputes, including patent, trade secret, and copyright litigation. With an educational background in both electrical and mechanical engineering, he specializes in cases involving software, electronics, and mechanical systems. He also leads the firm's FRAND licensing and Open Source Software audit and compliance practice, advising automotive OEMs and suppliers on standard essential patents for wireless communication technology.

Mr. LeRoy primarily represents operating companies, frequently defending major corporations in complex patent infringement lawsuits. His significant defense work includes acting as counsel for Ford Motor Company in several high-profile matters, such as Ethanol Boosting Systems, LLC et al. v. Ford Motor Company. In Versata Software v. Ford Motor Company, he led a team that successfully limited the plaintiff's damages claim from over $1.4 billion to just $3 after eight years of litigation and a three-week jury trial. He also secured an early dismissal for Ford in FMReps Consulting Enterprises, LLC v. Ford Motor Company by successfully arguing patent invalidity under 35 U.S.C. § 101. While predominantly working on the defense side, he was also part of the trial team that secured a $140 million patent infringement judgment, affirmed on appeal, for a local inventor against Microsoft.

LeRoy possesses extensive experience in post-grant proceedings, including Inter Partes Reviews (IPRs) and Covered Business Method Reviews (CBMRs), often coordinating these efforts with parallel district court litigation. Notably, he was involved in over 20 IPRs/CBMRs in the Versata case and successfully defended Ford Motor Company as PTAB counsel in Safe Driving Technologies, LLC v. Ford Motor Company, leading to 43 claims being held unpatentable, a decision later affirmed on appeal.

Mr. LeRoy earned his Juris Doctor from the University of Dayton. He also holds a Master of Science degree in Electrical Engineering from the University of Michigan and a Bachelor of Science degree in Mechanical Engineering from the University of Buffalo, where he graduated cum laude. He is admitted to practice before the United States Supreme Court, the Federal Circuit Court of Appeals, and is a registered patent attorney.
