Joe G. Chen

Joe G. Chen is a Partner at Fox Rothschild LLP, specializing in intellectual property law with a strong focus on patent litigation and strategic patent portfolio management. His practice encompasses patent drafting and prosecution, patentability and freedom-to-operate analyses, IP due diligence, licensing, and post-grant and inter partes review (IPR) proceedings. Possessing a diverse scientific background with advanced degrees in biology (Ph.D.), chemistry (M.S.), and computer science (M.S.), Dr. Chen’s technological expertise spans pharmaceuticals, therapeutic protein engineering, antibody and vaccine development, medical diagnostics, and cutting-edge areas such as artificial intelligence/machine learning, autonomous driving, and CRISPR gene editing. Before joining Fox Rothschild, he spent over a decade as a research fellow at a Fortune 500 pharmaceutical company, leading drug discovery programs.

Dr. Chen demonstrates versatility in patent disputes, representing both patent owners defending their intellectual property and challengers seeking to invalidate patents. While his tracked appearances include representing CONJUPRO BIOTHERAPEUTICS, INC. as a petitioner in a post-grant review (PGR) proceeding against Ascletis Pharma China Co Ltd, he also actively defends clients in district court litigation and has successfully protected patent owners' rights before the Patent Trial and Appeal Board (PTAB).

His notable experience includes successfully defending two biotechnology gene therapy patents for San Rocco Therapeutics, LLC in IPRs challenged by bluebird bio Inc., where all contested claims were upheld. He also successfully instituted two IPR trials on behalf of CSPC Pharmaceuticals against patents related to methods of treating metastatic pancreatic cancer and antibody-drug conjugates. Dr. Chen's PTAB involvement is significant, as he has presented oral arguments and played a key role in navigating complex discretionary denial issues. Beyond litigation, he advised CSPC Pharmaceuticals in an $18.5 billion licensing agreement with AstraZeneca, highlighting his transactional IP capabilities.

Dr. Chen is admitted to practice before the U.S. Patent & Trademark Office, as well as in New Jersey, New York, and the District of Columbia. His court admissions include the U.S. Court of Appeals for the Federal Circuit and U.S. District Courts for the District of Massachusetts and the District of New Jersey.
