Joe Chen

Joe Chen, Ph.D., is a Partner at Fox Rothschild LLP, specializing in intellectual property law with a diverse scientific background. His practice encompasses patent drafting and prosecution, global patent portfolio management, patentability and freedom-to-operate analysis, IP due diligence, licensing, post-grant proceedings, and IP litigation. Dr. Chen's technical expertise is rooted in advanced degrees in biology, chemistry, and computer science, allowing him to advise clients in pharmaceutical, biotechnology, and artificial intelligence/machine learning fields, including AI-based drug design, image analysis, autonomous driving, and facial recognition. Prior to his legal career, he spent over a decade in drug discovery and development at a Fortune 500 pharmaceutical company, working on therapeutic areas such as oncology, inflammation, and neuroscience.

In patent litigation, Dr. Chen's experience includes representing clients as both a plaintiff and in challenging patents through post-grant review. Based on tracked cases, he served as plaintiff counsel for CSPC Pharmaceutical Group Limited in CSPC Pharmaceutical Group Limited et al. v. Ipsen Biopharm Ltd. at the district court level. He was also a key member of the Fox Rothschild team that successfully instituted two Inter Partes Review (IPR) trials on behalf of CSPC Pharmaceuticals against Ipsen Biopharm Ltd., involving patents directed to methods for treating metastatic pancreatic cancer. Additionally, he contributed to another successful IPR institution for CSPC Megalith Biopharmaceutical Co. against Shanghai Miracogen Inc., concerning antibody-drug conjugates. He has also been involved in defending biotechnology gene therapy patents for clients such as San Rocco Therapeutics, LLC.

Dr. Chen regularly handles PTAB proceedings, with his professional profile specifically listing "post-grant and inter partes review proceedings" as a focus area. He earned his J.D. from Seton Hall University School of Law, holds an M.S. in Computer Science from New Jersey Institute of Technology, and a Ph.D. in Molecular Biology, Biochemistry, and Structural Biology from Indiana University-Bloomington, having also completed postdoctoral research at Princeton University. He is admitted to practice before the U.S. Patent & Trademark Office, in New Jersey, New York, and the District of Columbia, and before the U.S. Court of Appeals for the Federal Circuit, among other federal district courts.
