Jessica R. Kunz

Jessica R. Kunz is a partner in the Litigation group at Skadden, Arps, Slate, Meagher & Flom, based in Wilmington, Delaware. She focuses on intellectual property-related litigation, particularly in Delaware courts. Her practice has involved complex technologies such as mercury-capture technology for coal-fired power plants, as seen in the Midwest Energy Emissions Corp. et al. v. CERT Operations II LLC et al. case, and systems for online transactions.

Ms. Kunz primarily represents defendants, including operating companies, in patent infringement disputes. In a significant win for a corporate client, she represented JPMorgan Chase & Co. against Pi-Net International, Inc., successfully securing summary judgment against infringement claims related to online transactions, followed by the dismissal of an appeal to the Federal Circuit and the denial of certiorari by the U.S. Supreme Court.

While serving as lead counsel for the defendant CERT Operations II LLC in Midwest Energy Emissions Corp. et al. v. CERT Operations II LLC et al., the plaintiff Midwest Energy Emissions Corp. secured a $57 million patent infringement verdict against the CERT-entity defendants in March 2024. The jury found willful infringement of patents covering mercury-capture technology for coal-fired power plants.

Ms. Kunz earned her J.D. from Villanova University School of Law in 2011, graduating magna cum laude and as a member of the Order of the Coif. She also holds a B.S. in Neuroscience from Washington & Lee University, graduating magna cum laude in 2007.
