Jessica L. Gutierrez

Jessica L. Gutierrez is a partner at Robins Kaplan LLP, specializing in intellectual property and technology litigation. Drawing on her engineering background, she handles complex cases across a diverse range of technological fields, including medical devices, mobile device technology, computer software, energy, and consumer products. Her practice covers patent, copyright, and trademark disputes, guiding clients from pre-suit evaluation through appeal.

Gutierrez's experience demonstrates a balanced approach to patent litigation, representing both plaintiffs and defendants. While her tracked appearances include two defendant-side cases against Unified Patents, LLC (one of which involves PTAB proceedings), she also has one plaintiff-side appearance. Her firm, Robins Kaplan, is known for representing both patent holders and accused infringers.

She has played a key role in several notable outcomes, including achieving a $71.4 million judgment in a patent infringement trial for the inventor of prelit artificial Christmas trees, a verdict that was affirmed by the Federal Circuit. In 2024, she contributed to securing a $42.4 million verdict in a high-stakes patent infringement case, reportedly the largest patent jury verdict in the District of Minnesota's history. Additionally, Gutierrez was instrumental in obtaining a $13 million judgment on behalf of a veteran-owned software developer in a software copyright infringement trial against the United States Government, where she also secured a nearly $1.2 million sanctions award for evidence destruction.
