Jeremy Jason Lang

Jeremy Jason Lang is a patent litigation partner at Orrick Herrington & Sutcliffe, where he focuses on a wide spectrum of technologies, particularly semiconductor devices (including circuit design, fabrication, and memory technologies such as DRAM, Flash, and hard drives), communication technologies, and software applications. His practice also encompasses semiconductor tools, packaging, and design software. Lang joined Orrick in May 2018, having previously been counsel at Weil Gotshal & Manges.

Lang primarily defends operating companies against patent infringement allegations. His tracked case appearances, including representing Samsung Electronics Co., Ltd. in Netlist, Inc. v. Samsung Electronics Co., Ltd. et al., reflect this defendant-side orientation. He has secured favorable outcomes for clients, such as a summary judgment of no infringement for a global semiconductor manufacturing company in a CMOS imager technology dispute and a "walk-away with prejudice" settlement in an online gaming patent infringement action. He also achieved a favorable damages victory at trial for Hitachi in a hard drive patent infringement case.

A significant portion of Lang's practice involves Patent Trial and Appeal Board (PTAB) proceedings. He has an extensive practice in inter partes reviews (IPRs) and ex parte reexaminations, and is recognized as a "top-filer in inter partes reviews". Notable PTAB work includes representing Micron Technology, Inc. as a petitioner in an IPR against Yangtze Memory Technologies Company, Ltd., and TCT Mobile (US), Inc. as a petitioner against Fundamental Innovation Systems International LLC. He also represented Micron Technology, Inc. before the Federal Circuit in IN RE: MICRON TECHNOLOGY concerning a mandamus petition, and supported Micron in Supreme Court briefing regarding Appointments Clause challenges to the PTAB in the wake of Arthrex, Inc. v. Smith & Nephew, Inc..

Lang is admitted to practice in California and before the United States Patent and Trademark Office. He earned his J.D. from Emory University in 2003 and a B.S.E.E. from Georgia Institute of Technology in 2000.
