Specialty & background
Jay E. Heidrick is an accomplished intellectual property litigator and the Intellectual Property Litigation Chair at Polsinelli. His practice encompasses high-value intellectual property, contracts, and trade secret disputes, often handling "bet the company" cases with eight-figure damages at stake. Heidrick's technical experience spans a wide array of areas, including electronics, mechanical devices, medical devices, telecommunications devices, software, information technology, design patents, business methods, chemical processes, animal health sciences, nutritional supplements, and biosciences, as well as Paragraph IV disputes under the Hatch-Waxman Act.
Heidrick primarily represents defendants in patent infringement matters. His tracked appearances reflect a focus on the defense side, including his role as counsel for the defendant in RARE BREED TRIGGERS, INC. et al. v. RECOIL, LLC, DBA RECOIL GUN WORKS. His notable successes include securing a jury finding of no infringement and invalidation of a patent under 35 U.S.C. § 101 in PPS Data, LLC v. Jack Henry & Associates, Inc., which is believed to be the first such jury invalidation since the Federal Circuit's Berkheimer decision. He also obtained a defense jury verdict of non-infringement in Vehicle IP v. Werner Enterprises, Inc., involving a system for calculating fuel tax.
Heidrick possesses significant experience with the Patent Trial and Appeal Board (PTAB), having successfully represented clients in post-grant proceedings. In DataTreasury Corporation v. Jack Henry & Associates, Inc., he led the successful effort to grant a Covered Business Method Review (CBMR) petition, ultimately invalidating all asserted claims related to check processing software. He also successfully litigated and argued an appeal before the Federal Circuit Court of Appeals for a banking software provider, clarifying the law to permit demand letters from non-practicing entities as a basis for personal jurisdiction and venue.
Admitted to practice in all state and federal courts in Kansas and Missouri, as well as the U.S. District Courts for the Eastern and Western Districts of Texas and various appellate jurisdictions, Heidrick earned his J.D. from the University of Kansas in 2002 and a B.A. in History from Kansas State University in 1999.
