Jason Lao

Jason Lao is a partner and first-chair trial lawyer in Haynes and Boone's Intellectual Property Litigation Practice Group, based in the firm's Orange County and San Francisco offices. He focuses on litigating patent infringement, trade secret misappropriation, unfair competition, trademark, copyright, and licensing actions in federal and state courts and before the U.S. International Trade Commission.

Lao's practice spans a wide array of sophisticated technologies, including biotech, semiconductors, artificial intelligence, automotive technologies, wireless communications, smart meters, standards patents, trusted computing, digital rights management, satellite technology, virtual machines, and cybersecurity. His technical background as a process engineer for a major automotive corporation and a senior member of a Fortune 10 company's Computer Incident Response Team, where he specialized in network security and software analysis, underpins his ability to handle complex technical disputes.

He regularly represents both plaintiffs and defendants in high-stakes disputes, leading trial teams from preliminary injunctions through trial and post-trial proceedings. This balanced experience is reflected in his tracked appearances, which include cases on both the plaintiff and defendant sides. While specific patent litigation verdicts are not detailed, he has been recognized as a patent industry leader by Patexia in 2025. He also co-authored an article in 2018 discussing the impact of inter partes reviews (IPRs) at the Patent Trial and Appeals Board (PTAB) on patent acquisition strategies, indicating familiarity with post-grant proceedings.

Lao earned his B.S. in Mechanical Engineering from the University of California Berkeley, an M.S. in Computer Information Systems from the University of Michigan, and his J.D. from New York University School of Law. He was admitted to the State Bar of California on December 19, 2012.
