James Y. Pak

James Y. Pak is a highly experienced intellectual property litigator and counsel at Skadden, Arps, Slate, Meagher & Flom LLP, based in their Palo Alto office. His practice focuses primarily on patent infringement, trade secret misappropriation, and copyright infringement matters. Leveraging a background in computer science, Mr. Pak regularly handles cases involving complex technologies such as computer source code, wireless communications, data messaging, storage systems, databases, digital imaging, encryption, virtual reality, and operating systems security. He also maintains an active practice counseling video game publishers and studios on intellectual property issues.

While his tracked appearances show a defendant-side focus, including in Realtime Data LLC v. Reduxio Systems, Inc. et al. where he represented defendant-appellee Fortinet, Inc., Mr. Pak has successfully represented both plaintiffs and defendants. Notably, he was part of the team that secured a $500 million jury verdict for ZeniMax Media Inc. and id Software as plaintiffs against Oculus VR Inc. and Facebook in a lawsuit involving trade secret misappropriation, copyright, and trademark infringement related to virtual reality technology. He has also achieved favorable outcomes for clients such as Viewpointe Archive Services, obtaining a complete jury trial victory in patent litigation, and Rocket Software, where he successfully defended against a motion for preliminary injunction in a trade secret and copyright dispute that later settled.

Mr. Pak is well-versed in proceedings before the U.S. Patent and Trademark Office, representing clients at the Patent Trial and Appeal Board (PTAB). His experience includes one of the earliest covered business method (CBM) proceedings for Credit Acceptance. He counsels companies on various aspects of intellectual property, including acquisition, evaluation, licensing, and protection, and has significant experience in investigations related to intellectual property theft.

Mr. Pak earned his J.D. from Columbia Law School in 2007, where he was a Harlan Fiske Stone Scholar, and a B.S. in Computer Science from Columbia University in 2003. He is admitted to practice in California, New York, and Texas, and is registered to practice before the U.S. Patent and Trademark Office.
