James Tsuei

James Tsuei is a partner at Russ August & Kabat, specializing in intellectual property litigation with a focus on patent disputes. His practice encompasses a wide array of technologies, including smartphones, OLED displays, database management software, data compression, mobile device data management, wireless communication optimization, and ad-tech platforms.

Tsuei primarily represents plaintiffs in patent infringement actions, as evidenced by his full plaintiff-side appearance record across five tracked cases. Many of these engagements have involved representing Headwater Research LLC, identified as a non-practicing entity (NPE).

At Russ August & Kabat, Tsuei has been a key member of trial teams that secured significant jury verdicts. Notably, in April 2025, his team obtained a $278.7 million jury verdict for Headwater Research LLC against Samsung Electronics Co., Ltd. for infringement of wireless communications patents. While his team also achieved a $175 million jury verdict against Verizon Communications Inc. for similar wireless technology infringement in July 2025, that verdict was later overturned in April 2026, with the court finding that Verizon reasonably expected not to be sued. He also represented Datonics LLC against Amazon.com, Inc. in a case involving targeted electronic advertisements, which included an inter partes review (IPR) by Amazon, and a subsequent Federal Circuit remand of Datonics' patent application to the USPTO in February 2026.

Tsuei possesses experience before the Patent Trial and Appeal Board (PTAB), with his involvement in IPRs such as Amazon's challenge to Datonics' patent and Samsung's IPR against Headwater Research further illustrating this experience. Prior to joining Russ August & Kabat, he practiced at Durie Tangri LLP from 2015 to 2018 and Quinn Emanuel Urquhart & Sullivan LLP from 2012 to 2015. He earned his J.D. cum laude from the University of Pennsylvania Law School in 2012 and was admitted to the State Bar of California on December 5, 2012.
