James Quigley

James Quigley is a Principal in the Austin office of McKool Smith, focusing on patent and technology-related litigation and trial practice. His technical background in Electrical and Computer Engineering informs his work across a diverse range of technologies, including web applications, mobile phones, and integrated circuits, as well as voice processing systems and video communication technologies. Quigley also handles related trade secret, trademark, fraud, and breach of contract claims.

With extensive federal court experience, Quigley represents both plaintiffs and defendants in patent infringement actions, demonstrating a balanced practice with three tracked plaintiff-side appearances and two defendant-side appearances. He was part of the McKool Smith team that secured a PTAB victory for Parus Holdings against Google, where the Patent Trial and Appeal Board (PTAB) initially found claims of U.S. Patent No. 6,721,705 patentable, though this decision was later vacated by the Federal Circuit and remanded. He has also been involved in cases like Voxer, Inc. et al. v. Google, LLC (plaintiff side as lead counsel) and Voxer, Inc. et al. v. Amazon.com, Inc. et al. (defendant side as lead counsel while at Fenwick & West), concerning video communication technologies.

Quigley is active in inter partes review (IPR) proceedings, having represented both petitioners and patent owners, including arguing before the PTAB and on appeal at the Federal Circuit. He was also part of a trial team that secured a $173 million patent infringement verdict for ParkerVision, Inc. against Qualcomm. His career has included prior experience at Fenwick & West before his current role at McKool Smith.
