James Evans

James Evans is an experienced patent litigation attorney specializing in the pharmaceutical, biotechnology, and biologics sectors, particularly focusing on complex disputes under the Biologics Price Competition and Innovation Act (BPCIA). His practice is predominantly plaintiff-side, representing innovator companies in enforcing their patent rights against biosimilar challengers.

As Senior Director and Assistant General Counsel in the Disputes Resolution Group at Regeneron Pharmaceuticals, Inc., Mr. Evans oversees worldwide patent litigation matters for the company. His case involvement primarily centers on protecting Regeneron's blockbuster ophthalmic biologic, EYLEA® (aflibercept). He has been counsel for Regeneron in the significant Regeneron Pharmaceuticals, Inc. v. Mylan Pharmaceuticals Inc. et al. and Regeneron Pharmaceuticals, Inc. v. Formycon AG litigations.

In the Regeneron v. Mylan proceedings, the Federal Circuit affirmed preliminary injunctions and upheld Regeneron's 13-patent EYLEA® portfolio, blocking biosimilar entry. A permanent injunction was granted in Regeneron's favor following a nine-day bench trial in June 2023. Regeneron also reached settlement agreements with Mylan/Biocon, Sandoz, and Celltrion concerning EYLEA® biosimilars, generally allowing U.S. market entry in late 2026. Similarly, in the Regeneron v. Formycon matter, the Federal Circuit affirmed preliminary injunctions against biosimilar launch, and Regeneron later settled with Formycon, setting a launch date for Q4 2026. Mr. Evans has also been noted as a speaker on post-grant proceedings before the Patent Trial and Appeal Board (PTAB), indicating experience or oversight in IPR/PGR matters.

Mr. Evans holds a J.D., cum laude, from Quinnipiac University, an M.S. and Ph.D. in Immunobiology from Yale University, and a B.A., with High Honors, in Molecular, Cellular, and Developmental Biology from U.C. Santa Cruz.
