Imron Aly

Imron Aly is a seasoned patent litigation attorney with a practice primarily focused on complex intellectual property disputes, particularly in the pharmaceutical and life sciences sectors. He has extensive experience in Hatch-Waxman and biosimilar patent litigation, often representing generic and biosimilar manufacturers. His technological expertise also spans medical implants and devices, DNA arrays, mechanical production assemblies, computer business methods, and financial trading systems.

Aly's practice shows a strong plaintiff-side orientation, advising and representing clients in asserting their rights or challenging patents to bring products to market. For instance, he represented Fresenius Kabi in challenging Regeneron's EYLEA® patents, and has been recognized for his strategic counsel in enabling generic drug market entry. He has also led efforts for clients such as Nexus Pharmaceuticals in addressing companies selling unapproved products.

Currently, Aly is a partner at ArentFox Schiff, having joined Schiff Hardin in 2014, which later merged with Arent Fox. Before joining Schiff Hardin, he was a partner at Winston & Strawn. Aly is noted for his significant trial experience, having first-chaired more than 15 trials.

His notable cases include successfully representing Fresenius Kabi in an appeal against Hospira, Inc. concerning generic Precedex, which earned his firm's IP practice a "Hatch-Waxman Impact Case of the Year" award in 2020. He also secured a rare preliminary injunction for Fresenius Kabi against FERA Pharmaceuticals, LLC, preventing the launch of a competing generic thyroid hormone. The tracked case, Fresenius Kabi SwissBioSim GmbH v. Regeneron Pharmaceuticals, Inc., involved inter partes reviews (IPRs) against EYLEA® patents, leading to a settlement that allowed Fresenius's biosimilar launch. Aly is also recognized for his insights into PTAB and IPR proceedings, having authored articles on landmark Supreme Court decisions impacting these reviews.

Aly is admitted to practice in Illinois and Missouri and before the U.S. Patent and Trademark Office. He earned his J.D., magna cum laude and Order of the Coif, from Georgetown University Law Center in 1999, and a B.S.E. in Biomedical Engineering, cum laude, from Duke University in 1996.
