Iain Cunningham

Iain Cunningham is a Senior Litigation Counsel at Apple Inc., specializing in patent litigation with a focus on cutting-edge technology. His practice primarily involves defending Apple against patent infringement claims, particularly those concerning mobile technologies and consumer electronics. He has also represented Apple as a plaintiff in patent disputes.

His experience encompasses a range of technologies, including Near-Field Communication (NFC) payment systems and mobile location monitoring. For instance, he has been involved in CardWare Inc. v. Apple Inc., a case concerning NFC payment technology patents asserted against Apple Pay, iPhone, Apple Watch, and Apple Vision Pro. He also played a role in the litigation against Avant Location Technologies LLC, where Apple's "Find My" feature was accused of infringing patents related to monitoring mobile station presence.

Cunningham is actively involved in inter partes review (IPR) proceedings at the Patent Trial and Appeal Board (PTAB). In the Avant Location Technologies LLC litigation, Apple filed IPR petitions challenging all asserted claims of the plaintiff's patents and successfully sought to stay the district court case pending the PTAB's decisions. Apple has also filed an IPR against CardWare Inc. He previously practiced at Cooley LLP before joining Apple in 2010.

Iain Cunningham earned his law degree from UC Hastings (now UC Law SF) in 2004 and was admitted to the State Bar of California on December 1, 2004. Before pursuing law, he undertook graduate studies in computer science.
