He served as lead counsel for CSPC Pharmaceutical Group Limited in a district court case against Ipsen Biopharm Ltd. and successfully led Fox Rothschild's team in instituting two Inter Partes Review (IPR) trials on behalf of CSPC against Ipsen, challenging patents related to methods of treating metastatic pancreatic cancer and antibody-drug conjugates. These IPR successes also involved defeating attempts for discretionary denial of the petitions. Additionally, Suh was part of a team that successfully defended two biotechnology gene therapy patents for client San Rocco Therapeutics, LLC against IPR petitions filed by bluebird bio Inc. in April 2024. In March 2023, his team secured a victory for client RiceTec before the PTAB.
While his tracked district court appearance is for a plaintiff, his PTAB experience demonstrates work for both patent challengers (as petitioner for CSPC) and patent owners (defending patents for San Rocco and RiceTec). His practice includes coordinating appellate litigation before the Federal Circuit and the U.S. Supreme Court.
Howard S. Suh is admitted to the New York bar and the U.S. Court of Appeals for the Federal Circuit. He earned his J.D. from New York University School of Law in 1995 and a B.A. from Columbia University in 1990.
