Gina DiGioia

Gina DiGioia is the Chief Legal Officer of the live TV streaming company fuboTV, a role she has held since being appointed the company's first General Counsel in July 2020. In this capacity, she oversees all legal matters for the company, including litigation. Her work in patent litigation appears focused on defending fuboTV's streaming services and related software technologies. Before joining fuboTV, DiGioia was U.S. General Counsel and COO for the global technology company Fiizy and previously held general counsel positions at media companies Defy Media and Alloy. She began her legal career in private practice as a senior associate at Grant, Herrmann, Schwartz & Klinger.

Consistent with her in-house role, DiGioia's tracked patent litigation appearances are exclusively on the defendant side for fuboTV. Her most notable patent cases are the ongoing litigations brought by DISH Technologies L.L.C. and Sling TV L.L.C. in the District of Delaware. In this matter, DISH has accused fuboTV of infringing eight patents related to video streaming technology.

As part of its defense strategy in the DISH litigation, fuboTV has sought to invalidate the asserted patents by filing petitions for inter partes review (IPR) at the Patent Trial and Appeal Board (PTAB). According to company disclosures, the PTAB instituted review proceedings on all eight asserted patents, which prompted the district court to grant a full stay of the litigation pending the outcome of the IPRs. The IPR institution decisions were expected by November 2025.
